Recently (11/30/2023) the EPA released the proposed "Lead and Copper Rule Improvements" which outline other key requirements like public notifications, sampling changes to compliance tier site protocol (and required sampling in schools and day-cares, replacement schedules, lead connectors/goose-necks, and a new LOWER action level of 10 PPB.  


The LCRR states that water systems must replace all known lead service lines and what they call "galvanized service lines that are currently, or ever were connected to an upstream lead service line".  It is critically important that water systems have a very detailed "service line verification/identification plan" in order to understand your replacement efforts that will become effective after the compliance date.


EPA has a list of approved methods but vary based on where you are at in your LCRR compliance journey.  Sometimes you can use publicly available data, like home-build date (to determine prescense/absence of lead via when your state adopted the Federal Lead Ban for pipe, flux and solder), service line diameter (if over 2", you can usually classify as non-lead), sequential (non-compliance/voluntary) sampling, mechanical or hydro excavation, visual inspection and MORE.


Each State has provided an excel "template" that you will have to use unless they are using an online portal.  We can help you make the best decision based on your utility size and exisiting data environment (or lack-thereof :)  ).  Bottom line - you've got options and we'll help you find the best solution.


Simple and definite answer: YES, you must.  Even if you've never had a Lead (Pb) exceedence.  If you are 100% confident that you have no Pb pipes in your system, you can find and fill out a waiver stating as such, but the "proof" must be there i.e. visual inspections, entire system built after State Lead Ban was implemented, or very precise and accurate records for both the public and private service line connections. 


Short answer: Yes.  But like anything with state and federal government, it is kind of tricky :)


The Bipartisan Infrastructure Law provides $50 billion to support upgrades to the nation’s drinking water and wastewater infrastructure. This includes $15 billion dedicated to lead service line replacement and $11.7 billion of general Drinking Water State Revolving Funds that can also be used for lead service line replacement.  In addition, the EPA’s water technical assistance (WaterTA), including the recently launched “Get the Lead Out” Initiative, helps communities identify lead services lines, develop replacement plans, and apply for funding to get the lead out.
